Information concerning the protection and processing of personal data


In accordance with art. 13 section 1-2 and art. 14 section 1-2 of (EU) Regulation 2016/679 of the European Parliament and of the Council of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Regulation on the Protection of data) (EU Journal of Laws L 119, p. 1) - hereinafter GDPR - we would like to inform you that:

 

1. ADMINISTRATOR OF HOTEL GUESTS’ PERSONAL DATA

The Administrator of Hotel Guests’ personal data is JW Waligóra Sp.j. (general partnership). You can contact the Administrator by writing at the following address: Siedliska 495, 36-042 Lubenia; e- mail address: eventy@spasplendor.pl 

 

2. PURPOSES OF PROCESSING HOTEL GUESTS’ PERSONAL DATA
The purpose for which the Hotel processes personal data is the conclusion and implementation of a contract for the provision of hotel services. In addition, the purpose of processing personal data by the Hotel is:
1. pursuing any claims by the Hotel in connection with the damage suffered by the Hotel and caused by the Guest or defense against the Guest's claims against the Hotel,
2.documenting the performance of the service for tax purposes,
3. providing the highest quality services for Hotel Guests
4. answering queries regarding services rendered

In the event that the Guest has consented to the processing of personal data for marketing purposes, the Hotel processes personal data for this purpose, i.e. to send marketing information and offers about its products and services to the Guest. In addition, the Hotel processes the personal data of Guests collected by hotel video surveillance in order to ensure the safety of Hotel Guests and other persons staying at the Hotel.

 

3. LEGAL BASIS FOR PROCESSING OF PERSONAL DATA
1. The legal basis for processing Guest’s personal data obtained by the Hotel is a contract for the provision of hotel services.
2. The legal basis for processing Guest's personal data used for marketing purposes is the Guest's consent. The Hotel informs that the consent may be withdrawn at any time. Withdrawal of the consent does not affect the validity of the processing that took place before the withdrawal of the consent.
3. The legal basis for the processing of the Guest's personal data by video surveillance is protection of his vital interests and protection of the vital interests of other natural persons, as well as the justified purpose of the administrator.
4. The legal basis for the processing of Guest's personal data to ensure the highest quality of services for Hotel Guests is the administrator's justified purpose.

 

4. ENTITIES TO WHICH PERSONAL DATA MAY BE TRANSFERRED
The Hotel transfers personal data to the following categories of entities:
1. companies providing the Hotel with IT support services and IT software,
2. accounting companies providing accounting services,
3. transport and taxi companies when the Guest orders transport or courier service,
4. law offices providing legal advisory and legal representation services.

 

5. PERIOD OF PROCESSING OF PERSONAL DATA
Personal data:
1. obtained in connection with the concluded contract for the provision of Hotel services will be processed for the period of limitation of tax claims or civil law claims of the Hotel or Guest, depending on which of these events occurs later,
2. obtained on the basis of consent for marketing purposes will be processed for the period of validity of the consent for marketing purposes,
3. obtained in connection with video surveillance will be processed for 30 days from the date of capture and then will be permanently removed.

 

6. GUEST'S RIGHTS IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA
Each Guest has the right to access personal data, rectify, delete or limit processing. In addition, each Guest has the right to object to the processing. Access to data is possible at the headquarters of the Hotel.

 

7. TRANSFER OF DATA TO A THIRD COUNTRY

The Hotel does not intend to transfer personal data to a third country or international organizations.

 

8. POSSIBILITY OF LODGING A COMPLAINT IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA
Each Guest has the right to lodge a complaint regarding the processing of his personal data to the supervisory body, which is the President of the Office for Personal Data Protection.

 

9. REQUIREMENT TO PROVIDE PERSONAL DATA
Providing personal data – full name, address, email address, telephone contact number, child's age, in case of a hotel stay with the child, and vehicle registration number, in case of parking at the hotel, is a requirement to conclude a contract for hotel services. Failure to provide personal data will prevent the Hotel from concluding a hotel service contract.

 

10. AUTOMATED DECISIONS BASED ON PERSONAL DATA, INCLUDING PROFILING
The hotel does not make automated decisions based on personal data, including profiling.
